الشروط والأحكام

مرحباً بك في /formance. بزيارتك لموقعنا أو استخدامه أو تقديم طلب شراء، فإنك توافق على الالتزام بالشروط والأحكام التالية (بالإضافة إلى سياسة الخصوصية وسياسة الشحن والاسترجاع). إذا كنت لا توافق على أي جزء من هذه الشروط، يرجى عدم استخدام الموقع أو تقديم طلب

معلومات عامة عن المتجر
•  يدير الموقع /formance، وهو متجر إلكتروني متخصص في تصميم وتفصيل الملابس والفساتين المخصصة حسب الطلب (custom-made)

•  جميع المنتجات مصنوعة يدويًا خصيصًا لكل عميل، مما يعني أنها غير متوفرة جاهزة في المخزون

3.الطلبات والدفع
•  عند تقديم طلب، تقدم معلومات دقيقة (المقاسات، التفاصيل، العنوان، إلخ). أي خطأ في المعلومات المقدمة قد يؤدي إلى تأخير أو إلغاء الطلب دون مسؤولية علينا.
•  يتم تأكيد الطلب بعد استلام الدفع الكامل (أو الدفعة المقدمة حسب الاتفاق).
•  الأسعار المعروضة تشمل الضرائب المطبقة وتكاليف الشحن تُحسب منفصلة عند الدفع
•  نحتفظ بحق تعديل الأسعار أو إلغاء الطلب في حال وجود خطأ فني واضح في السعر.

4. المنتجات المخصصة
•  بما أن المنتجات مفصلة حسب طلبك الشخصي، فهي غير قابلة للإرجاع أو الاستبدال إلا في حالات العيب المصنعي الواضح أو عدم التطابق الجوهري مع المواصفات المتفق عليها (انظر سياسة الاسترجاع والاستبدال).
•  نحن غير مسؤولين عن أي اختلافات طفيفة ناتجة عن اختلاف الشاشات أو الإضاءة في عرض الألوان/الأقمشة.

5. الملكية الفكرية
•  جميع التصاميم، الصور، الشعارات، والمحتوى على الموقع ملك لـ/formance مرخص لنا.
•  لا يجوز نسخ، تعديل، توزيع، أو استخدام تجاري لأي محتوى.

6. المسؤولية
•  نحن نسعى لتقديم منتجات عالية الجودة، لكننا لا نتحمل مسؤولية الأضرار غير المباشرة أو التبعية الناتجة عن استخدام المنتجات أو الموقع.
•  الموقع مقدم دون ضمانات صريحة أو ضمنية خارج ما ينص عليه النظام السعودي.

7. الإلغاء والتعديل
•  يحق لنا إلغاء أي طلب أو رفضه في أي وقت لأسباب مشروعة (مثل عدم توفر المواد، أخطاء في السعر،).
•  يمكن إلغاء الطلب قبل بدء عملية التفصيل فقط، مع إمكانية خصم رسوم إدارية أو دفع إلكتروني.

8. القانون المنظم والفصل في النزاعات
•  تخضع هذه الشروط لقوانين المملكة العربية السعودية، بما في ذلك نظام التجارة الإلكترونية ولائحته التنفيذية.

9. التعديلات على الشروط
•  نحتفظ بحق تعديل هذه الشروط في أي وقت. التعديلات تُنشر على الموقع، واستمرار استخدامك يعني موافقتك عليها.

Welcome to /formance. By visiting our website, using it, or placing an order, you agree to be bound by the following Terms and Conditions (in addition to our Privacy Policy, Shipping Policy, and Return Policy). If you do not agree with any part of these terms, please do not use the website or place an order.
General Information About the Store
• The website is operated by /formance, an online store specialized in designing and tailoring custom-made clothing and dresses (custom-made).
• All products are handcrafted specifically for each customer, meaning they are not available ready-made in stock.
3. Orders and Payment
• When placing an order, you must provide accurate information (measurements, details, address, etc.). Any error in the provided information may result in delay or cancellation of the order without liability on our part.
• The order is confirmed upon receipt of full payment (or the agreed deposit).
• Displayed prices include applicable taxes, and shipping costs are calculated separately at checkout.
• We reserve the right to adjust prices or cancel the order in case of an obvious technical error in the pricing.
4. Custom-Made Products
• Since the products are tailored according to your personal request, they are non-returnable and non-exchangeable except in cases of clear manufacturing defect or substantial non-conformity with the agreed specifications (see Return and Exchange Policy).
• We are not responsible for any minor variations resulting from differences in screens or lighting when displaying colors/fabrics.
5. Intellectual Property
• All designs, images, logos, and content on the website are owned by /formance or licensed to us.
• No copying, modification, distribution, or commercial use of any content is permitted.
6. Liability
• We strive to provide high-quality products, but we are not liable for any indirect or consequential damages arising from the use of the products or the website.
• The website is provided without express or implied warranties beyond what is stipulated by the Saudi regulations.
7. Cancellation and Modification
• We reserve the right to cancel or reject any order at any time for legitimate reasons (such as unavailability of materials, pricing errors, etc.).
• An order may be cancelled only before the tailoring process begins, with possible deduction of administrative or electronic payment fees.
8. Governing Law and Dispute Resolution
• These terms are governed by the laws of the Kingdom of Saudi Arabia, including the Electronic Commerce Law and its Executive Regulations.
9. Changes to the Terms
• We reserve the right to modify these terms at any time. Modifications will be posted on the website, and your continued use constitutes acceptance of them.
